Special VFR
This element is about Special VFR (SVFR) — the narrow controlled-airspace exception that lets a VFR pilot operate in weather below standard VFR minimums when the operation can be conducted safely under ATC oversight. The DPE will probe both the regulatory mechanics (when it's available, what minimums apply, what equipment is needed) and the judgment call (when SHOULD you ask for it).
SVFR is a tool, not a fallback. It exists in controlled surface areas only, requires explicit ATC clearance, and gives you 1 SM and clear of clouds — meaning you and only you are responsible for cloud avoidance. Day: any pilot. Night: instrument-rated pilot in IFR-equipped aircraft. Some airports opt out entirely.

What airspace are you in or entering?
When special VFR is available
SVFR exists only in controlled airspace with a surface area — Class B, Class C, Class D, or Class E surface area. The rule is in . Three categories of airspace are excluded entirely:
- Class A — IFR only, so VFR concepts including SVFR don't apply
- Class G — uncontrolled, so its own permissive weather minimums govern (1 SM clear of clouds day, 3 SM with cloud clearances night for the typical sub-1,200 AGL band); no SVFR needed or available
- Class E above the surface — the standard 3-152 (below 10,000 MSL) or 5-111 (at or above 10,000 MSL) minimums govern; SVFR doesn't reach controlled airspace that doesn't extend to the surface
Even within the four eligible airspace classes, some specific airports prohibit SVFR entirely. The list lives in Part 91 Appendix D, Section 3 — mostly the busiest hubs (LAX, ORD, ATL, JFK, LGA, SFO, DEN, DFW, MIA, etc.). The prohibition exists to prevent SVFR conflicts with high-volume IFR arrivals into these airports. A pilot at one of these fields requesting SVFR will be told "Special VFR is not authorized at this airport."
To find out whether your specific airport allows SVFR: check Part 91 Appendix D, or just ask ATC — the controller will know.
Daytime versus nighttime requirements
Daytime SVFR. 1 SM visibility (ground visibility if reported, flight visibility otherwise) and clear of clouds. Any pilot certificate level can request and exercise daytime SVFR. The aircraft needs no special equipment beyond what's already required for the airspace it's operating in.
Nighttime SVFR. Day minimums apply (1 SM + clear of clouds), plus two additional requirements under (b):
- The pilot in command holds an instrument rating, and
- The aircraft is equipped for instrument flight per
Both conditions must be met — not "one or the other." A non-instrument-rated pilot in an IFR-equipped aircraft, or an IR-rated pilot in a non-IFR-equipped aircraft, cannot exercise night SVFR.
The night additions exist because 1 SM with limited visual cues at night is borderline IFR. The FAA effectively requires IFR-grade qualifications to ensure the pilot can recover if the operation degrades. The legal night-SVFR pilot in good equipment can fly the night clearance; the borderline pilot who's "almost" qualified cannot.
The night equipment list under is the standard IFR equipment list: 2-axis gyroscopic instruments, sensitive altimeter, clock with sweep second hand, generator/alternator, radios appropriate for the route, gyroscopic pitch-and-bank indicator, etc. Plus the night-VFR equipment under applies because the flight is at night.
The day visibility floor stays at 1 SM — same as daytime. The night additions are pilot and equipment, not weather.
Requesting and operating under special VFR
SVFR requires an explicit ATC clearance — not just two-way comm establishment. The phraseology matters.
Departure request. Before takeoff: "Falcon Tower, Cessna 12345, holding short of runway 4L, request Special VFR clearance to depart for the east." The controller checks current conditions, traffic, and the airport's SVFR status, then issues a clearance: "Cessna 12345, Falcon Tower, cleared out of the Class Delta surface area, maintain Special VFR conditions, report clear of the airspace."
Arrival request. Before entering the surface area: "Phoenix Tower, Cessna 12345, 10 east, request Special VFR for landing." The clearance: "Cessna 12345, Phoenix Tower, cleared into the Class Charlie surface area, maintain Special VFR conditions, enter on a 45 for runway 25R."
Key elements of the clearance:
- The phrase "Special VFR" must appear explicitly
- Direction or specific airspace boundary specified
- The pilot must maintain SVFR conditions (1 SM + clear of clouds) throughout the clearance
- The clearance ends when the pilot reports clear of the controlled surface area (departure) or lands (arrival)
If conditions degrade below 1 SM or you can't maintain clear of clouds during the clearance, declare the situation to ATC immediately. Options: request vectors to better conditions, climb to standard VFR mins above any layer, or in extremis declare an emergency and request IFR services (if equipped and qualified). The 1-SM-clear-of-clouds standard requires real-time pilot judgment — there's no separation service inside the SVFR clearance.
Worked examples:

KFFZ departure with 800 ft BKN and 2 SM. Falcon Field is Class D. Visibility 2 SM is below the Class D 3-152 standard. Ceiling 800 ft BKN is below the 1,000-ft above-clouds clearance. SVFR is the legal tool. Pilot request: "Falcon Tower, Cessna 12345, holding short 22L, request Special VFR for departure to the east." Tower checks conditions and traffic, clears: "Cessna 12345, cleared out of the Class Delta surface area, maintain Special VFR conditions, report clear." Pilot departs, maintains 1 SM and clear of clouds beneath the broken layer, exits the surface area boundary and reports clear. Now in Class E with standard 3-152 mins applicable — if visibility is 3+ SM and cloud clearance can be maintained (or pilot climbs above the broken layer to clear conditions), continue VFR. If conditions don't improve, divert.

KLAX arrival denied. Pilot inbound to LAX with marginal conditions tries to request SVFR. Tower response: "Cessna 12345, Special VFR is not authorized at LAX. Maintain VFR, advise intentions." LAX is on the Appendix D no-SVFR list (along with most major hubs). Options: divert to a satellite field (Hawthorne KHHR, Long Beach KLGB, Van Nuys KVNY) that allows SVFR, or hold until conditions return to standard VFR. Plan for this preflight — never assume SVFR is available at major airports.

Night SVFR at a small Class D. Cessna 172 pilot at 2300 local, ceilings 900 ft BKN, 2 SM visibility at a Class D tower-controlled airport. Pilot holds private pilot certificate, no instrument rating. SVFR is not available at night without the instrument rating. Options: wait for VFR mins to return, wait for daylight (likely many hours), divert to a different airport with conditions you can meet. The night SVFR door is closed; recognize that and adjust.
